AKTOR Appeal Dismissed, Clearing Way for Paphos–Polis Chrysochous Road Re-Tender

Authority’s decision reinstates the tender process for Phase A of the motorway.

The Tenders Review Authority has unanimously rejected the appeal submitted by AKTOR against the re-tendering of the contract for completing the study and construction of Phase A of the Paphos–Polis Chrysochous road, according to a decision issued on 19 November. Following the ruling, the temporary suspension of the award procedure has been lifted and the tender documents are now available through the e-procurement system.

According to a statement by the Legal Service, the Tenders Review Authority examined all eleven grounds for annulment raised in the appeal and, based on the arguments presented before it, concluded that all grounds failed and were dismissed for the reasons explained in the decision.

Background on the Re-Tendering Process

On 8 August 2025, the Department of Public Works launched an open tender for the “Completion of the Study and Construction of the Paphos–Polis Chrysochous Motorway, Section 1 – Phase A”.

The need to launch a new tender arose from the termination of the contract previously signed between the Republic and INTRAKART (later AKTOR), which had been selected as the contractor during an earlier procurement process. On 18 August 2025, AKTOR filed an appeal before the Tenders Review Authority seeking, among other remedies, the cancellation of the re-tendering procedure, the annulment of specific elements of the tender, or alternatively, the amendment or supplementation of its terms.

The case was handled on behalf of the Attorney-General of the Republic by State Attorney Rena Papaeti-Hatzikosta, State Attorney Kyriaki Papadopoulou and State Attorney Maria Kelepesii.

In a separate announcement, the Ministry of Transport, Communications and Works, through the Department of Public Works, stated that following the Authority’s decision, the temporary suspension of the award procedure—imposed on 22 August 2025—no longer applies.

The tender documents are now accessible to all interested economic operators via the e-procurement system.
